Consumer Health Data Privacy Notice

This notice describes how Magnum Telehealth LLC d/b/a Magnum Health collects, uses, and shares consumer health data that may not be PHI governed by HIPAA. It is intended to supplement the Website Privacy Policy and to address consumer health privacy laws that may apply to information collected before a patient-provider relationship is established or outside a HIPAA-covered system.
1. Consumer Health Data We May Collect
Depending on how you interact with us, consumer health data may include:
- Health conditions, symptoms, diagnoses, treatment interests, wellness goals, medication use, allergies, side effects, contraindications, and medical history.
- Height, weight, body measurements, vital signs, laboratory results, hormone information, photographs, and other physical or biological information.
- Information relating to reproductive, sexual, metabolic, mental, or behavioral health when voluntarily provided and relevant to requested care.
- Information about prescriptions, pharmacy use, purchases of health services, or participation in a treatment program.
- Information that identifies or could reasonably be used to infer a person’s health status or health-care needs or interests.
- Precise geolocation only if you affirmatively enable a feature that requires it. We do not use geofencing around health-care facilities to identify or track people seeking health services.
2. Sources of Consumer Health Data
We may collect consumer health data directly from you; from your authorized representative; from licensed clinicians, pharmacies, laboratories, or care partners; from devices or services you choose to connect; and through inferences from your interactions with treatment-related webpages or forms.
3. Purposes for Collection and Use
We collect and use consumer health data to respond to your inquiry; determine preliminary program eligibility; facilitate scheduling and intake; connect you with licensed clinicians; coordinate laboratory, pharmacy, shipping, and support services; provide requested services; maintain safety and security; comply with law; and carry out other purposes disclosed to you or authorized by your consent.
4. When We Share Consumer Health Data
We may share consumer health data with your treating clinicians and the professional entity responsible for care; pharmacies and laboratories; patient-portal, scheduling, payment, communications, hosting, and support vendors; shipping and fulfillment providers; professional advisers; government authorities when required by law; and other parties at your direction or with your consent.
We do not sell consumer health data. We do not share consumer health data for targeted advertising. We do not permit advertising platforms to receive health-intake responses or authenticated patient-portal activity.
5. Affiliates and Third Parties That May Receive Consumer Health Data
Depending on the services you request, we may share consumer health data with the following affiliates and service providers when reasonably necessary and permitted by law:
- Magnum Telehealth LLC d/b/a Magnum Health and participating licensed clinicians or professional entities responsible for evaluating or providing care.
- SimplePractice, which may support patient portal, scheduling, intake forms, records, and communications.
- Square and other payment processors used to process payments and prevent fraud.
- Licensed dispensing pharmacies identified during enrollment, in patient communications, or on the prescription or medication label.
- Quest Diagnostics or another laboratory provider selected for testing or specimen collection.
- Shipping and delivery carriers, including UPS, FedEx, or the United States Postal Service, when needed to deliver medication or program materials.
- Website hosting, cybersecurity, customer support, document storage, communications, and other vendors acting on our behalf under applicable privacy and security obligations.

6. Consent
Where consent is required, we will request consent before collecting or sharing consumer health data for a new purpose. Consent for collection or sharing is separate from any authorization that may be required for a sale. Because we do not sell consumer health data, we do not request authorization to sell it.
7. Your Consumer Health Data Rights
Subject to applicable law and exceptions, you may request:
- Confirmation of whether we collect, share, or sell your consumer health data.
- Access to the consumer health data we maintain about you.
- A list of third parties and affiliates with whom your consumer health data has been shared.
- Withdrawal of consent for future collection or sharing.
- Deletion of consumer health data from our active systems and, where required, archived or backup systems and the systems of processors.
- An appeal if we deny your request.

8. Deletion Limitations
We may retain information when required or permitted by law, including medical-record, prescription, fraud-prevention, tax, security, legal-claim, and regulatory obligations. Deletion from backups may occur on the next scheduled restoration or deletion cycle when allowed by law.
